Synopsis

This document, which represents an in-depth analysis of the oral report, first describes the historical-political context that characterized the long-awaited new law on the legal profession, which would replace the discipline dating back to the years 1933/1934, a waiting period that finally ended with the promulgation of Law 31.12.2012 n. 247. The complex implementation phase of this new system is further discussed and achieved through the adoption of multiple regulatory instruments (necessary for its implementation), which the law itself refers to. Furthermore, it exposes the salient characteristics of Law 31.12.2012 n. 247 and its specific contents: the new statute of the lawyer, the forms and methods of practicing the profession, the consolidation of the system of professional orders in an objective and subjective sense (mainly, ordine circondariale, Consiglio nazionale forense and Congresso nazionale forense), the access to the profession (internship and State exam), ethics and the Code of ethics for lawyers, disciplinary power and the related procedure. Ultimately, the needs for the reform of Law 31.12.2012 n. 247 are described, which have emerged in the meantime within the lawyers and created possible evolutionary changes of the outline of the legal system: the initial works aims at developing a harmonious and united project of a new professional law in step with the present times.
