L’halal friendly come opportunità per un mercato europeo inclusivo
Synopsis
The essay explores the issue of consumer law from an intercultural perspective, highlighting how compliance with shari‘a by various sectors of the consumer market may be able to satisfy the spiritual requirements of the believing consumer and, at the same time, to show an identity and cultural sign of a concrete opening towards a Europe that wants to be a promoter of dialogue between the different legal systems. Halal lifestyle is a rapidly developing area of the consumer market, which means the need to strengthen the accuracy and completeness of information to consumers through halal labelling. The latter is a tool of trust, which can however be lost since it is plausible that through the labelling may be violated the conformity of the good with the consumer’s religion or beliefs or, more generally, with the ethical aspirations of the same. This means that it is necessary to reflect in terms of remedies, when the consumer has not made an informed choice or when a lack of conformity has been identified, taking into account not only national laws but also the prospects of harmonization of European private law, in particular those pursued by Reg. EU 1169/2011 and Dir. EU 771/2019.
