By referring to three specific decisions of the Italian Constitutional Court relating to the exercise of judicial functions, it is possible to draw some conclusions about the construction of the principle of gender equality, in its specific “anti-subordination” form. This goes beyond the mere (albeit fundamental) anti-discriminatory perspective to arrive at a notion of constitutional complex equality that values genders without neutralizing or assimilating them.
