Synopsis

In Latin America, and beyond, the indigenous question has raised a general call for radical democratization and decolonization, for greater justice and equity.

This interdisciplinary collection of essays offers an updated overview of the situation and evolution of the rights of the indigenous peoples in that region, highlighting both the achievements and progress concerning individual national contexts, as well as the criticalities, contradictions and violations that has been characterizing the whole continent still today.

These essays clearly show how the struggles of latin american indigenous peoples for the recognition and protection of specific cultural rights, new forms of autonomy and profound institutional transformations are contributing to redefine the language, theory and practice of human rights and modern State.

Author Biographies

Roberto Cammarata, University of Milan

Associate Professor of Political Philosophy at the Università degli Studi di Milano, where he teaches Political Theory and Analysis of Political Language. Among the topics of his researches: multiculturalism; political and legal pluralism; universality and cultural particularism of human rights; rights of indigenous peoples in Latin America; feelings of justice; quality of public discourse. Among his publications: Indigeno a chi? Diritti e discriminazioni allo specchio (Giappichelli, 2012); La sfida del pluralismo al diritto, ai diritti, allo Stato. Teoria e casi di diritto plurale (LiberEdizioni, 2015); La via latinoamericana ai beni comuni. Il buen vivir e i diritti della natura nel nuovo costituzionalismo andino, in: T. Mazzarese (a cura di), Ricucire il mondo. La necessaria sinergia tra diritti fondamentali e beni comuni (Brixia University Press, 2021).

Marzia Rosti, University of Milan

Associate Professor of History and Institutions of the Americas at the Università degli Studi di Milano, where he teaches History and Institutions of Latin America and Indigenous Peoples, Institutions and Rights in Contemporary Latin America. Among the topics of her researches: evolution of relations between native peoples and nation-states in Latin America; recognition and implementation of indigenous rights and emerging issues (territorial claims; free, informed and prior consultation; environmental protection).
